End-User License Agreement (EULA)
This End-User License Agreement (“EULA”) is a legal contract between you (“Licensee” or “User”) and the Developer (or Licensor) of the software product “FkNeo” (the “Software”). By installing, accessing, or using the Software, you agree to be bound by the terms of this EULA.1. License Grant and Use Restrictions
The Developer grants the Licensee a limited, non-exclusive, non-transferable license to install and use the Software solely for educational, experimental, and demonstration purposes (the “Permitted Use”).Prohibited Uses
The Licensee SHALL NOT use the Software for:- Commercial purposes or for any form of monetary gain.
- Cheating in academic exams, tests, or assessments of any kind.
- Reverse engineering, decompiling, or disassembling the Software.
- Copying, modifying, distributing, or selling the Software.
2. Intellectual Property and Ownership
The Software is licensed, not sold. The Developer retains all ownership, intellectual property rights, and interest in and to the Software, including all copies. This EULA grants the Licensee only the right of use as expressly set forth herein and grants no ownership rights in the Software.3. Term and Termination
This EULA is effective until terminated. The Developer may terminate this EULA immediately and revoke the license if the Licensee breaches any of the terms, particularly the Prohibited Uses (Section 1). Upon termination, the Licensee must immediately:- Cease all use of the Software
- Delete all copies of the Software
4. Limitation of Liability and Indemnification
4.1. User Responsibility
The Licensee agrees that they are solely responsible for any consequences, damages, or liabilities arising from the use or misuse of the Software.4.2. Risk Allocation and No Refund Clause
The Licensee acknowledges and agrees that after purchasing the license, if the Software stops functioning due to the intervention of any third-party company (particularly Examly), software, system changes, or external factors, the Licensee is responsible for the resulting loss and shall not be entitled to a refund of the license fee.4.3. Limitation of Developer Liability
The Software is provided “AS IS,” without warranty of any kind. To the maximum extent permitted by applicable law, the Developer shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages (including, but not limited to, loss of data, loss of academic standing, or loss of profits) arising from the use or inability to use the Software.4.4. Indemnity
The Licensee agrees to indemnify, defend, and hold harmless the Developer from and against any claims, losses, damages, or costs resulting from the Licensee’s use or misuse of the Software or any violation of this EULA.By filling the license grant form, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this EULA.
